COMPARISON OF THE 2017 & 1999 FIDIC CONTRACTS”

 

OVERVIEW

This three-day training seminar will provide an up-to-date understanding of the main 1999 FIDIC construction forms of contract (Red, Yellow and Silver) and the recently published 2017 2nd Edition of the FIDIC Rainbow Suite of Contracts.

The seminar begins by introducing FIDIC and the FIDIC suite of contracts, consideration of some important clauses of the Books, comparing and contrasting them with respect to certain key issues and latest developments. A particular focus shall be given to the major revisions introduced with respect to the key aspects of the Conditions in the 2017 Editions. The seminar will cover explanations, illustrations and case studies for the use of the FIDIC Conditions of Contract. Additionally, participants of the seminar will be provided with understanding of 10 most common contractual issues on Construction projects.

The course is presented in 12 sessions and includes details of the changes in principle as well as in presentation. The key changes in each of the 21 main Clauses (1999 Contract has 20 Clauses) are identified and flow charts are given where appropriate on the new procedures required.

 

SEMINAR TUTOR:

Robert Werth is a Civil and Construction Engineer, experienced in international construction business; he is a FIDIC approved Adjudicator and a FIDIC accredited international Trainer.

Robert Werth has over two decades of international experience gained when working with or on behalf of owners, operators, contractors, lawyers and consulting organisations, on numerous projects throughout Germany, Austria, Slovenia, Croatia, Lithuania, Latvia, Estonia, Russia, Ukraine, Denmark, Serbia, Slovakia, Turkey, Czech Republic, Poland, Malts Cyprus, acting in various capacities, including advocate in pursuit and defence of claims, as an independent expert and/or as appointed Adjudicator in case of disputes.

He serves on FIDIC contracts, such as Red, Yellow, Silver, Gold, Yellow plus operation, Gold Book, White Book, or EPC-Contracts, also Concession-, BOT- or BOOT-agreements and various kinds of tailor made contracts.

  • FIDIC Conditions of Contract for Construction ( 2017 Red Book) 2nd Edition
  • FIDIC Conditions of Contract for Plant & Design-Build (2017 Yellow Book) 2nd Edition
  • FIDIC Conditions of Contract for EPC/Turnkey Projects (2017 Silver Book) 2nd Edition
  • Schedule of overheads used during the seminar – to be used as “Work Book”
  • Work Exercises for use within the course
  • Delegates are requested provide their own 1999 FIDIC Contracts
